Some Trump supporters were claiming the audio could be fabricated or doctored but (in addition to witnesses testifying toherwise):

Quote

On social media [Trump] admitted the voice in the recording is his but insisted its contents actually exonerate him. [...]
Trump [...] claiming he "didn't have a document, per se," and that there "was nothing to declassify" because the papers heard rustling in the tape "were newspaper stories, magazine stories, and articles," not classified documents.

[...] There's no mandatory minimum prison sentence for these charges, which means the judge will have discretion in sentencing.

Republicans Need to Accept Trump Is Clearly Guilty (thedailybeast.com)

So even if she doesn't dismiss the case, Cannon can let him off with a fine---maybe some 'community service'....
The tape makes it pretty clear that it's not a newspaper / magazine story he's showing them---that would make no sense. They clearly see the document. And he says the information in it is classified.
Apparently the document still hasn't been found though. One could try to argue that Trump was making it up, but the tape seems to indicate that the other people in the room were able to read enough of the document to see what it was about---would Trump have printed out a fake classified document with made-up information to make the lie seem more convincing? It seems unlikely. And if his lawyers can't get anyone to testify that that's what happened, they apparently won't be able to present that argument to the jury---not explicitly at least.

OTOH:

Quote

If [...] Cannon sticks to her initial decision to hold the trial in Fort Pierce, Fla., the jury would be drawn largely from counties [...] Trump won handily [...] "It is solid, solid Trump country."

Trump Trial Setting Could Provide Conservative Jury Pool - The New York Times (nytimes.com)

Of course it only takes one juror to prevent a conviction....

If Trump gets sentenced to community service he might make it into a photo-opp---not the usual 'oh look at the virtuous candidate serving food to the homeless' but 'oh woe is Trump look at poor King Trump being forced to pick up litter it's like he's being crucified by garbage the DOJ and FBI are leftist monsters'

It's not the only time Trump has made weird noises while trying to make his points. In fact, there's now a whole compilation of his creepy sounds while pretending to lift weights.

Why We Have to Take RFK Jr. Seriously

The mercurial Democrat is a falconer, bodybuilder, and influential anti-vaxxer.

RFK Jr. is a pandemic-era candidate. (slate.com)

Okay, I'm convinced....

Presidential debate should be shirtless ripped 70-year-old RFK Jr. and his falcon vs Trump pretending to be a cis woman having an orgasm while lifting weights.

(In all seriousness Trump's mockery of female weightlifters shows that of course he doesn't really care about fairness in women's sports---and for most Republicans it's primarily just another pretext for hate. And suggesting it should be one of the most important issues in the presidential race is ludicrous.)

I think it primarily shows that he is an insensitive dick that should be nowhere near a position of power and a post that should be a role model for Americans.
Yesterday, upon the stair, I saw a man who wasn't there. He wasn't there again today. Oh, how I wish he'd go away.

'There are more trans bans than trans athletes': what's driving anti-LGBTQ+ hate in America?

[...] a cis girl sued after a 2018 high school track meet in which two trans girls beat her. She went on to win scholarships and championships and run NCAA track. The trans girls have been harassed out of sports altogether. One "save women's sports" group could only name five examples of a trans girl participating in K-12 sports. Twenty states have banned trans athletes. There are more states with bans than there are openly trans athletes. West Virginia appealed to the supreme court to try and kick one 12-year-old girl off her track team. So it's important to remind folks of the upside-down nature of the actual stakes.

'There are more trans bans than trans athletes': what's driving anti-LGBTQ+ hate in America? | LGBTQ+ rights | The Guardian

Quote

[...] a lot of the loudest questioners and protesters of trans women in sports are also preoccupied with shoving trans people out of every other conceivable corner of polite society, and they're concocting arguments on the fly in order to relocate trans people to those margins. [...]

The people on the front lines of the media and political cause against trans athletes don't care an ounce about the sports they claim to be saving. [...]

For one example, take Clay Travis, a longtime sports media personality who now plays the role of a firebrand conservative talk-radio host with a huge show. [...]

[...] If women's sports did die out completely, Travis would see that as the loss of a second-rate product. "Men's sports are better than women's sports because men are the objectively better athletes," he said. And if anyone wants to talk about women's sports on their own terms, instead of as a setting to exclude trans people from, Travis again sounds different. He responded to a startlingly normal ESPN tweet about three great WNBA players by telling the network to stop its "descent into woke sports engineering."

[...] The politicians who actually pass the laws aimed at trans athletes act, en masse, similarly. [...]

The New Republican Litmus Test Is Very Dangerous

War with Mexico? It's on the 2024 ballot, at least if you believe the campaign rhetoric of more and more Republican candidates.

[...] a rhetorical escape from the political dilemma that Republicans and conservatives face.

[...] Republican lawmakers have little appetite for a domestic crackdown that would criminalize so many of their own constituents and their constituents' relatives. At the retail level, many a "dealer" is also a user[...] Contemporary conservatism tells a fable about virtuous middle-Americans beset by alien villains. [...]

[...] Compassion for us. Violence for them.

[...] Three years ago, proposals to bomb Mexico would have sounded crazy. But if enough people repeat the talk—if it is debated, amplified, and validated by trusted commentators—the talk gains power. It becomes thinkable, sayable, and then ultimately doable. [...]

[...] Despite Lindsey Graham's vivid language, the Mexican criminal cartels are not in fact at war with the United States. They are doing business with the United States—a lethal business, but business all the same. As rational profit-maximizers, they take care to avoid direct confrontations with American power. [...]

But what if the U.S. begins bombing and rocketing cartel operations? Will the old restraints still apply? What would then deter the cartels from extending their violence across the border? "The enemy gets a vote," goes an old warning. If the United States opts to escalate a law-enforcement challenge into a military conflict, it must prepare for its well-financed, well-armed antagonist to respond in kind. And unlike previous irregular antagonists, [...] this is one that intimately understands and has deeply penetrated U.S. society.

Don't Bomb Mexico - The Atlantic

If the cartels do retaliate, hopefully they'll focus more on Republican politicians, their supporters, and US military / enforcement agencies instead of terroristic attacks on targets of opportunity like immigrant communities (which would probably just result in more violent bombing campaigns / counter-counterattacks... unless Republican extremists actually like the cartels attacking immigrants or left-leaning concentrated urban areas, or even Republican areas for more political fuel for the war spiral... devout Republicans may be willing to choose real life everyday death cult over 'peace').

Just dropping by to say I do appreciate the US satanic temple.
https://www.nytimes....us-freedom.html (sorry for the pay wall)

Quote

The temple created an abortion ritual, a recitation of tenets about individual control over one’s body and the importance of making decisions based on science. Its general counsel, Matthew Kezhaya, said the ritual strengthens legal claims by linking “abortion and the religion itself” and establishing a practice “interfered with by these particular laws.”

The temple’s telemedicine service is currently available in New Mexico, where abortion is legal, but it plans to expand to states with bans and religious freedom laws, temple officials said. It has an intentionally inflammatory name, Samuel Alito’s Mom’s Satanic Abortion Clinic (after the Supreme Court justice who wrote the opinion overturning Roe), but it follows standard medical procedures, employs experienced reproductive health nurses and is listed by a national clearinghouse of legitimate medication abortion services.

It will take a few decades but I look forward to the fight. I just checked, they were declared a tax emept church in 2019 by the IRS.

What I find interesting about the supreme court and its recent rulings however is that we speak of 6 conservative justices and 3 liberals and this divide clearly exists. However should such a divide be possible and does its existence not prove a prima facie case that there is a flaw in the system. The supreme courts job is to interpret if a law as written by the legislature is constitutional. It seems that like some religious texts the constitution can be read anywhich way you want to match your existing beliefs. 9 people read the constitution and 6 somehow think that free speech means you can discriminate against theoretical gay wedding websites and 3 read the constitution and believe the right against discrimination means if you want to sell websites you cant discriamte on sexual orientation. I have never read all the details that go into such a court ruling but if both sides can write a thesis with citations to support either position something is flawed.

The Justices don't really read the constitution though. My view is that something like 85% of all Justices have been basically the equivalent of bloggers with educational papers and clerks. Lately, the corruption in the Supreme Court (over the last 30 years) has been very overt.

Alito writing a defense of his corruption in the Wall Street Journal prior to the article exposing an instance of his corruption being publicly released is a very strong sign that the bullshit levels are very high.

I'm speaking as someone who has been to the Supreme Court to hear oral arguments, spent years poring over decisions, and have a family friend who made all that his life's work for 50+ years. He was my professor for a year at law school too.

https://www.albanyla...phen-e-gottlieb

He's firmly of the opinion that the Roberts Court will go down in history as one of the most corrupt + actively destroying the normal boundaries of what that Court should do ever and that we should pack the court. He was saying this before 2015 (when he published a book saying the Roberts Court was unfit for democracy) too.

I definitely see your point, and maybe in a vacuum it would seem like partisanship. The thing is, in this case it's not just a matter of interpreting the Constitution, with two partisan 'sides' coming to different conclusions -- there's decades of legal precedent the conservatives threw away in the process of their decision too. There are protected classes, and sexual orientation is one of them. If you're going to be a company selling products or services to the public, there are long-standing rules (by which I mean laws) regulating what you can, can't, and must do. That includes not discriminating against people based on their race, sex, sexual orientation, and a few (very few honestly) categories.

This ruling twisted itself into a pretzel divorcing all these rules of commerce to pretend this was a 1st Amendment issue. But the plaintiff was not acting as a religious institution, nor even as an individual, but as a COMPANY called 303 Creative doing business with the public. Everything in the precedent suggests she should not be able to discriminate, in the same way a bakery couldn't discriminate against a black customer, and the 3 dissenters on the court stuck with that very clear, very (seemingly) settled precedent. What the conservatives did had nothing to do with interpreting the Constitution or settled law, but was a deliberate erosion of those protections for LGBTQ people. This is less a matter of partisanship as it's usually thought of, and is very much one 'side' behaving within the bounds of precedent and norms and the other going scorched earth on everything.

They came with white hands and left with red hands.

It's just another instance of conservative projection. For years they claimed more liberal judges were judicial activists legislating from the bench. What they really meant was, just you wait... we are going to cram our people in there, even if it takes screwing around with Senate nominations and once we do... oh boy. Game over libtards!

And now you see as plain as day as the decisions don't even make fucking sense. Plain view reading, legislative history, and narrowly curtailed decisions, all staples of purported conservative jurisprudence are handwaved away in a pretty transparent fashion.

Trouble arrives when the opponents to such a system institute its extreme opposite, where individualism becomes godlike and sacrosanct, and no greater service to any other ideal (including community) is possible. In such a system rapacious greed thrives behind the guise of freedom, and the worst aspects of human nature come to the fore....

lol I wish.

Here's Biden malfunctioning again:

Quote

Biden was caught on film nibbling a child's dress during a trip to Helsinki, Finland [...]

The moment — which was caught on Newsmax, Thursday — showed Biden approaching a young girl who was being held by her mother, before nibbling her dress with his mouth for several seconds as the girl pulled away. Biden then pushed his face towards her head, prompting the girl to turn away from the president and towards her mother.

The clip went viral on social media, with many critics condemning Biden's actions

Sky News host James Morrow says Joe Biden has been caught "nibbling the youngsters" and showing "general exhibiting behaviours" which would see him banned from every shopping centre in the US. "Joe, stop eating the children," Mr Morrow said.

Presumably he wasn't intentionally trying to provoke QAnon (by 'he' I mean Biden---IDK about that sky asshole)....

Trump's campaign (or RFK Jr's) may put out ads consisting of a highlight reel of all the ridiculous and nonsensical things Biden has said over the years. To which Biden's campaign would respond in kind.

Hopefully any reduction in new streaming content from the WGA/SAG-AFTRA strike won't increase Trump's popularity (because people want to be entertained)... but I think he needs to come up with some new material (or maybe not, if he gets enough support from the elderly and they like hearing the same thing again and again ('Great Again'...).

On second thought maybe Trump doesn't need fresh material:

Quote

The charisma of the populist leader comes[...] from his ability to use language to captivate people's minds. [...] to wreak moral chaos on the polity through his deceitful use of words to create a mind fog that obscures reality and produces its own illusory world. He does this through a constant mind-numbing repetition of the same metaphors, slogans, clichés, and catchwords. In literary circles, speech based on clichés or repetitive formulas is discouraged and considered to be anathema to good style. Trump's discourse is the exact opposite of this style. This is intentional. He uses it as an antidote to the politically correct speech of the élite (academics, liberal politicians, Democrats, and so on); it is his language of the "revolution." As such, he is perceived as the charismatic leader who will take the nation out of the fog and back into the light—to use common metaphors that follow him around. [...]

Research shows that this language taps into and "switches on" existing circuits in the brain that link together important and salient images and ideas. Metaphors in particular bypass higher cognitive reasoning centers to make linkages that may not have a basis in reality. And when that happens, a person is less likely to notice the lie, because it "feels" right.'

"Train and socialize": Expert on linguistic anthropology explains how Trump is warping MAGA minds | Salon.com

... but IDK if that will appeal to a large enough % of voters for Trump to win legitimately. Polls still neck-and-neck with US democracy on the chopping block... by the end of Trump's final term(s) hopefully the public will be ready to be ruled by beneficent AI (or at least by scientists... nah, not very likely anytime soon; more likely deepfakes will convince them we're in the actual Biblical end-times and deepfake Trump is wrathful immortal baby Jesus).

Wait....

Florida is seriously going to be teaching that slavery benefitted black people by teaching them skills like blacksmithing. When I first heard this I thought this was one of those ridiculous ideas that maybe some nut had proposed not that it had become an actual curriculum. As if black people had never joined the iron age on their own. I don't know where to begin. I can only imagine the cringe so many teachers will feel navigating this absurdity.

Id rather live in America today than Angola but to say slavery benefited the slave 400 years ago is so batshit insane and disgusting

The fourth name is John Henry, also listed as a blacksmith.

Detailed facts about the real John Henry are disputed, and his status is principally a folk hero.

[...] The eighth name is Jupiter Hammon, listed as a fishing and shipping industry worker.

Jupiter is the FIRST name in the list so far who was actually a slave—all his life—and was a writer and poet. If he worked in that industry, it was in that capacity.

[...] Crispus was indeed a slave, and became a sailor after escaping slavery, but he was born inland in Massachusetts, and his slaver's work was cattle.

[...] Elizabeth was indeed a slave, and learned how to be a seamstress while a slave. But it was her enslaved mother who taught her how to do that, while her slavers raped her.

[...] The 16th name is Booker T. Washington, listed as a teacher.

Booker was born [...] nine years before the emancipation of slaves, and was illiterate through the entirety of his enslavement. He taught himself to read.

In New England, the Puritans targeted Akan-speaking people from the Gold Coast, who had a long military tradition emphasizing discipline and quick thinking. Also, an enslaved man named Onesimus taught Puritan leader Cotton Mather a technique for smallpox for inoculation, which he said was common in his African homeland.

Chesapeake enslavers wanted people like the Kru, specifically for their skill for boatbuilding. [...] slave traders marveled at the superior stability and speed of West African canoes, some of which they said could hold 100 people. [...]

[...] in Texas, enslavers wanted a subset of enslaved people in South Carolina descended from the Fulani, because they were already skilled herders. The term "cowboy" likely originates from this South Carolina group; there's evidence the African tradition of singing to a herd at night influenced what became cowboy songs

[...] As for "being a blacksmith" [...] Africans all over the continent already knew how to forge iron and other metals with great skill [...] That's why masterpieces like the Benin Bronzes were later stolen and ended up in British and American museums.

Note to Florida and DeSantis: Enslaved Africans were already skilled (msn.com)

DeSantis literally snorted when asked about [...] Kamala Harris's claim that the Florida guidelines "want to replace history with lies," [...]

[...] Fox has of course gone crazy over the story. The right is particularly incensed that Harris went to Florida [...] to excoriate the standards personally.

[...] Cooke has made a niche for himself mocking Harris[...] but she really enraged him with her attack on Florida's slavery curriculum as a form of "gaslighting."

"This is a brazen lie," Cooke huffed. "It's an astonishing lie. It's an evil lie. It is so untrue — so deliberately and cynically misleading — that, in a sensible political culture, Harris would be obligated to issue an apology."

At regular intervals on Monday, Fox featured a chyron denouncing Harris's "evil lie." [...]

[...] Slavery has long been presented, by its defenders, as somehow of "benefit" to the enslaved. In 1837, notorious pro-slavery South Carolina Senator John Calhoun [...] gave a famous speech, "Slavery A Positive Good," in which he declared, "Never before has the black race [...] from the dawn of history to the present day, attained a condition so civilized and so improved, not only physically, but morally and intellectually." [...]

While the Florida guidelines emphasize the teaching of "the trades of slaves (e.g., musicians, healers, blacksmiths, [...] painters, coopers)," almost "all of [Florida's] slaves (98 percent) were involved in agricultural labor," [...] most of which was not skill-building but back-breaking. [...]

The bottom line of DeSantis' "Stop Woke Act" is to squash all teaching on race that might lead a white child to believe she or he "bears personal responsibility for and must feel guilt, anguish, or other forms of psychological distress." That's the highest priority of many of these measures, in other states too [...]
