McConnell's Senate seat is up for election in the November midterms, and Kentucky law forbids the governor from appointing a temporary replacement---it can only be done by special election. So if they don't hold a special election before the November election, and they announce that McConnell is dead, his seat will just remain vacant until the November election. Kentucky is a deep red state---do you think a Democrat would be likely to win a special election, especially for McConnell's temporary replacement before the November midterms?

The law the republicans passed in Kentucky for this eventuality may be illegal under kentucky state constitution or whatever the equivalent is called. The governor has speculated he does have the right.

My understanding is that if Beshear waits until on or after August 3rd for Mitch's seat to be vacant, then it would make it unlikely a special election could happen before the general election in November. Assuming Beshear contests the 2024 Kentucky statue preventing him from making a temporary appointment, then Beshear would be able to appoint someone (presumably a Democrat) to the vacant seat. This appointment would last until Mitch's term was supposed to have ended (January 3rd, 2027).

Versus, if he called a special election now by pushing the matter, it's likely a Republican would win.

Fucks sake. You don't have a rule of law in the USA anymore. You haven't for a long time. We went through this already. The other side does what they want when they want. DO IT AND LET THEM STOP YOU. you guys keep saying "Well they CAN'T do that.".....newsflash they ALWAYS JUST DO IT and challenge anyone to stop them, and no one does. So why the other side plays by the supposed rules anymore is baffling to me.

@Worry, he's going to be replaced by a Republican anyways...so it would serve to call the rest of their bluffs that the MFer is legit braindead and hold them politically accountable so their constituents can see they've been lied to for a month. I don't for a second believe he will be replaced by a decent person...but if this were a democrat the Republicans would be breaking HIPPA and the Law to get into the hospital to prove the senator was dead.
