A man was acquitted of rape today after a jury agreed his victim could not have been sexually assaulted while wearing skinny jeans.

Nicholas Gonzales, 23, told a court in Australia that sex with the 24-year-old woman was consensual, despite her claim he had ripped off her size six skinny jeans before the attack.
The Sydney jury sent a note to the judge during the trial asking for more information about 'how exactly Nick took off her jeans'.

The note from a jury member added: 'I doubt those kind of jeans can be removed without any sort of collaboration.'

The not guilty finding follows two other courts - in Seoul and Italy - dealing with the question of whether a woman wearing the tight-fitting jeans can be raped.

In the Seoul case in 2008, the court overturned a seven-year sentence of a man convicted of raping a woman wearing skinny jeans.

But in the same year an Italian court upheld a rape conviction, ruling that 'jeans cannot be compared to any type of chastity belt.'

Mr Gonzales, the Sydney court was told, had met his victim for drinks in April 2008 before going to his house to listen to music.

The woman said they had gone upstairs to his room so he could play his drums - but he had pushed her onto the bed and lay on top of her.

'I struggled to try to get up for a while and then he undid my jeans and he pulled them off,' she said, before adding that she was then raped.

Questioned by defence lawyer Paul Hogan, the woman said she weighed 42 kilograms (6.6 stone) and did not find it difficult to squeeze in and out of her jeans.

Mr Hogan said: 'I'm suggesting it's difficult for skinny jeans to be taken off by someone else unless the wearer's assisting, collaborating, consenting.' 'Ii would disagree,' the woman replied.

Miss Veronica Wensing, chairwoman of the National Association of Services Against Sexual Assault, told the Sydney Morning Herald that a woman's outfit should not be an issue in alleged rapes.

'Any piece of clothing can be removed with force,' she said.

I agree. What state are these jeans in? Did the jury see them? And what size jeans was she wearing relative to her body type? In-court demonstration of the ease/difficulty of removing said clothing?

Two things:

Skinny jeans are no harder to rip off than any other pair of trousers if the person wearing them is trying to hold them up.

And I didn't know Crocodile Dundee was a defense lawer.

I wouldn't mind though there being a certain way to make yourself safe from being accused - there's plenty of nutjob women who first say they want sex and have it rough, the next time you see them is in court being accused of rape...

As a juror I would probably require such a demonstration... ;)

Based, of course, on the attractiveness weight of the woman to be used as a metric for the requisite tightness of her pants...

I cant help but feel that the article is misleading. Im sure there was more to this case than just a pair of jeans.

Edit-Having just read the context or the rest of the e-mail I get the impression that the jury was in doubt if the event was non-consensual because after meeting for drinks they went back to his place to 'listen to music', they than went up to his bedroom to 'play his drums'. Of course a women can change her mind, of course date rape is a real thing. But thats some ambiguity right there.

Yep, its not about "was sex or wasnt sex", key is if she slipped them gladly and after hangover realized that she really didnt want to or he got her from that stupid thing of clothes against her will.

But frankly, if he wants to fu... .. make love to something with 42kg...he cant be normal at all. (hello to anorexia nervousa!)

frankly, I'm appalled at this jury. Probably,
1) none of them ever wore skinny jeans;
2) they would have condemned her too if she was wearing a mini skirt, cause then she would just ask for it;
3) they went with their own thoughts and didn't ask for proof or tests or an expert.
4) her weight suggests she is tiny. How big is this guy? Would he have been able to keep her pinned while busy with the jeans?

Well with modern courts taking years to get to a case, maybe it's been 2 years since the incident and she's put on some weight in the meantime, and the jury didn't realize such and figured the pure suction of trying to remove the jeans would have caused an implosion that would have knocked any assailant through the wall?

That's some crazy shit. I can't make up my mind. On the one hand, the idea that wearing skinny jeans is sufficient to question the legitimacy of the accusation is a bit of a stretch. At the same time, though, how stupid is this girl? If she didn't want to sleep with him why did she go over to his house? Why did she accept to go to his room?

Basically, trying to determine if sex was consensual in this case is fucked. Too many gray areas, too much ambiguity.
