Regardless of who took off who's pants, if at any time she said stop (and meant it) then it was rape. The problem is being able to prove that she said stop.

That's the problem with rape/sexual assault cases. They are ugly messes because generally it comes down to he said vs. she said. At that point, prior actions and events are called into question to verify the veracity of the statements being made.
So, the woman gets a long, drawn out detailing of her sexual history. It's one of the primary reasons sexual assault/rape cases aren't pressed nearly as often as the event occurs.
I don't want to get into the skinny jeans thing because I don't know the facts of the case.

Trouble arrives when the opponents to such a system institute its extreme opposite, where individualism becomes godlike and sacrosanct, and no greater service to any other ideal (including community) is possible. In such a system rapacious greed thrives behind the guise of freedom, and the worst aspects of human nature come to the fore....

One of the reasons it so often comes down to he-said-she-said, besides the stigma attached to being raped and an unfortunate hesitance of victims to come forward immediately, is that even when they do come forward rape kits are such low priorities that they often just sit idle and ignored.
This has come up as an issue recently in Los Angeles. Last year (or maybe late 2008) it was publicized that Los Angeles had up to 12,000 rape kits backlogged and untested, and a lot of uproar led to the city council approving measures in the budget last May that would facilitate the testing through hiring more specialists. It just so happens that in 2010, with the issue seemingly settled, LA city council decided not to fill or fund the new positions after all, letting the backlog stagnate even further. I have a feeling this is a situation not confined to the city of Los Angeles.

it is more he-said-she-said in date-rape cases then abduction-rape cases
