I wasn't sure if the Supremes would go all the way, or if Roberts would convince a couple of the other Republicans (obviously not Thomas or Alito) to follow his preferred method of slowly chipping away at abortion rights. Looks like Roe and Casey are both gone.

'It's not just abortion. The logic of this draft decision would also apply to the decisions protecting same-sex marriage, contraception, and more.

[...] If the reasoning of the draft becomes the majority opinion [...] then it applies equally to Obergefell v. Hodges, which held that all marriages (including my same-sex one) are protected by the Constitution, to Lawrence v. Texas, which held that all intimate sexual activity (including same-sex) was too, and to Griswold v. Connecticut, which held that the right to access contraception is as well.

[...] To be clear, Justice Alito didn't leave this to speculation.'

'Blackburn warning us of plans of some in GOP to outlaw [...] birth control

The [US] senator said she finds the case that ruled a law banning birth control was unconstitutional to be "constitutionally unsound."'

I believe the thinking also applies to Loving vs Virginia. I wonder if Thomas would finally find a reason to recuse himself if that came up again :)

There have been rumblings in some red states about going after contraception which, paired with abstinence only sex-ed, would undo all gains made against teen pregnancy. But hey, it's mostly old rich white guys passing the laws there, so what do they care.

“Boy, these conservatives are really something, aren't they? They're all in favor of the unborn. They will do anything for the unborn. But once you're born, you're on your own. Pro-life conservatives are obsessed with the fetus from conception to nine months. After that, they don't want to know about you. They don't want to hear from you. No nothing. No neonatal care, no day care, no head start, no school lunch, no food stamps, no welfare, no nothing. If you're preborn, you're fine; if you're preschool, you're fucked.”

― George Carlin

EDIT:

I could be wrong, but would this not fuck up a LOT of the actual Senatorial and other Republicans that engage in behind closed doors 'things' that might result in unwanted pregnancies? Like how does this not bite them in the ass too?

Because they have money to send their wives/daughters/mistresses to blue states or other countries (canada) that allow it.

edit - to be clear, the core of conservatism is rules that protect, but do not constrain, the in-group, while their rules constrain, but do not protect, everyone else.

AKA anyone who isn't a white, evangelical, man, is on their 'second class citizen' list.

Yes, but some of these state laws would allow for 'prosecuting people from states where the procedure is illegal who attempt to seek abortions in states where it remains legal'---or 'anyone involved in its commission, even tangentially, whether "present or absent" if they aid, abet or even counsel someone. Experts say this could be deployed against a wide range of friends, loved ones or counselors, such as clergy or abortion fund networks which help shepherd people to clinics.'

But a friendly governor might pardon them (and their mistresses/wives/etc. too, if they 'behave'...). 'Good ole boys'....

'State legislatures have spent recent decades "modifying their criminal codes" in ways that "completely changes the calculus when it comes to what it would mean to go back to pre-Roe times," [...]

Criminal charges could come from specific abortion laws, but also from criminal codes that penalize attempted crimes, conspiracies and accomplices to crime, all relics laws developed during the US's so-called war on drugs. Those laws "could subject a wide range of individuals to criminal penalties if Roe is overturned", [...]

For example, Louisiana law defines an "accomplice" to a crime as anyone involved in its commission, even tangentially, whether "present or absent" [...]

More than 2,000 police agencies across the US have already purchased "mass extraction" technology that allows them to download, organize and archive a phone's entire contents. The technology is sometimes called a "window into the soul". This digital evidence has then been used to identify search queries for abortion pills[...]

[...] They could use "reverse geo-fencing" technology, to create a digital border around a location of interest – perhaps a clinic – and identify all phones that enter.

"The danger about a world where the states can criminalize abortion, again, is that the tools they have to investigate every crime have increased exponentially with surveillance technology,"'

Sounds like this is the right time to invest in the wire coat hanger industry.

Lawsuits and threat of criminal prosecution could cause related stocks to plunge. (Unless you want to be like Shakespeare with his grain, and hoard the pills to resell.)

Also, large numbers of people will be getting abortions in neighboring states... '[non-federal] law enforcement is not permitted to cross state borders to arrest you as this is a violation of state jurisdiction. Every state has different rules that dictate what happens [...] or if they will transfer the individual at all.'

https://www.davidmck...d-out-of-state/

But vigilantes---perhaps police from the state where it's banned, or from the state where it's not---could forcibly bring people across the border (drop them off... they may even make a superhero movie about it---Christianman?).

Might boost turnout for the midterms, especially in Pennsylvania---since we're electing a new governor. Current Democratic governor has vowed to veto any anti-abortion bills the gerrymandered perpetual Republican legislature puts forward.

Hopefully there wouldn't be too many people voting Democratic for governor but going with 'Doctor Oz' (or whoever wins the Republican primary this month) for Senator....

'Democratic pro-choice Gov. Tom Wolf has repeatedly vetoed bills that would further restrict abortion access passed by Pennsylvania's Republican-controlled House and Senate.'

'number of people within driving distance of Pennsylvania who could seek abortions there will increase by more than 1,000% if Roe is overturned — from 170,000 annually now, to 2.1 million.'

Overturning Roe could make Pa. a destination for abortions - WHYY

Whatever happens this should be rubbed in Susan Collins stupid fucking face for pretending to believe Brett "I like beer" Kavanaugh when he said that RvW was settled law.

Am I being Naive in thinking that if this happens, the political backlash would be huge. 70% of Americans support abortion. Seventy Percent!

If they undo Roe how does every republican politician not get abndoned by voters, female voters especially untill they promise to fix it. Im no expert but I always thought a lot of the anti-abortion rhetoric was used to anchor the evangelical vote while knowing that Roe Vs Wade existed so they didnt have to actually follow through. This will be hugely unpopular. They will anchor the evangelical vote but lose female voters everywhere else.

Also I see Roberts has slammed the leak. Does that confirm that the judgement is definitely real? I also cant help but wonder if the conservative side leaked it themselves. Test the waters to see if the public would really allow it.

'Connecticut lawmakers pass bill to protect abortion seekers and providers from out-of-state lawsuits

[...] who provide an abortion or receive support to obtain the procedure in Connecticut and are then sued in another state.

[...] The measure would block state agencies from assisting in interstate investigations or prosecutions that would hold someone criminally or civilly liable for providing, seeking, receiving or asking about abortion services legal in Connecticut.

[...] The measure was prompted by the controversial Texas law that allows private citizens to take civil action to enforce its ban on abortion[...]

[...] the legislation is necessary [...] to block red states that seek to curtail abortion rights from enforcing those restrictions beyond their borders.'

Connecticut lawmakers pass bill to protect abortion seekers and providers from out-of-state lawsuits - CNNPolitics

But if they ever enter the state where they're being sued, or where there's a warrant for their arrest... or they're a company with employees or property in the state...

Reminder that RvW is based off 'privacy', so they are coming for others things associated with that concept now, and it would appear that Gay Marriage and Contraception are up next - Alito mentions them in the leaks as "Phony law"....these motherfuckers won't stop until it's the goddamned 1850s again.

1. SCOTUS overturns RvW
2. Power to make laws re abortion moves to state level
3. Red states and borderline states where Republicans are in power pass sweeping anti-abortion laws
4. Sane people able to leave those states leave
5. SCOTUS reverses other same-sex and privacy related decisions
6. Same states pass more anti-laws
7. More people relocate
8. Gilead.

... and with some of these laws anyone who enters those states can be arrested and prosecuted for what they're suspected of having done out of state, so people will avoid traveling through those states....

Apparently 22 (!!) of the States have laws that fucking TRIGGER the minute SCOTUS overturns RvW.

That's a planning level that is despicable.

Yep. Hell, McConnell's refusal of Merrick Garland is and was ALL about this exact issue.

So, any guesses on who the leaker was? I've read outgoing Breyer. I guess the leak is supposed to be an egregious breach of SCOTUS protocol (and is a first).

Also, the word of the day is "codify." What would that accomplish? What criteria would have to be met? Take me to law school, oh nerdy wonky law experts.

I wonder if they even realize that their actions are directly undermining the economic and military power of the US? These two are pretty much entirely dependent on the proper education of children and young people.
Screw you all, and have a nice day!
